TAROM Denied Boarding Compensation

TAROM overbooking compensation / denied boarding compensation.

How much is flight overbooking compensation? Rules? How to get it? If your TAROM flight is overbooked, and you are denied boarding involuntarily, you are protected under the EC Regulation 261/2001. According to this regulation, you are entitled to receive care from TAROM, and, in some cases, EU denied boarding compensation of up to €600.

Keep in mind that it applies only to overbooking. If you are denied boarding due to some other issues, you won’t be entitled to care and compensation.

There are two ways you can claim this compensation.

1. TAROM Overbooking Compensation: EU Denied Boarding Regulations

Have you been denied boarding by TAROM? 

What are your rights? Can you get compensation for the inconvenience? The EU regulation states that when it comes to denied boarding due to overbooking, the rules are simple – you have a right to care and, possible, to compensation.

If you’re flying to or from Europe with TAROM, and you are involuntarily denied boarding due to overbooking — you are entitled to flight overbooking compensation (EU denied boarding compensation) up to €600. 

This only applies to overbookings.

If you are denied boarding due to some other issues (expired passport, no visa, etc.), you won’t get compensation from TAROM. Also you aren’t entitled to compensation if you are denied boarding voluntarily (voluntarily give up your seat).

By Europe and EU here on this page (and on this website in general) we mean all EU Member States, the United Kingdom (UK), Guadeloupe, French Guiana, Martinique, Reunion, Mayotte, Saint Martin (French Antilles), the Azores, Madeira, the Canary Islands, Iceland, Norway, and Switzerland.

1.1 Voluntary Denied Boarding

What is voluntary denied boarding?

Yes, there are different types of denied boarding. 

But first things first — what is overbooking? Overbooking is when an airline sells more tickets than there are seats on the plane. It is done to ensure that there are no empty seats at take off. But when all passengers turn up for their flight, the airline has to deny boarding to some of its passengers.

At first, the airline will look for volunteers. These volunteers will be given a new flight and some perks such as a free meal, instant compensation (cash or vouchers), and a free hotel stay (if the next available flight is only on the next day).  

If your TAROM flight is overbooked, the airline will look for volunteers. If you accept the offer, you are one of those volunteers, and it’s called voluntary boarding denial.

In this case, you aren’t entitled to denied boarding compensation from TAROM.

You don’t have to agree to an offer like this.

1.2 Involuntary Denied Boarding

There are situations when passengers don’t have a choice.

Your TAROM flight is overbooked, and there are not enough volunteers. Then the airline will bump people from the plane involuntarily. If that’s what has happened to you, know that it’s called involuntarily denied boarding, and you will be eligible for compensation.

What happens in case of involuntary denied boarding?

  • The airline must book you on a new flight or offer a full refund for the flight;
  • In addition to that, you are entitled to receive care from the airline*;
  • You are entitled to compensation up to €600 per passenger. 

* TAROM must offer you free meals and drinks in a reasonable relation to the waiting time, two free phone calls, e-mails or faxes. If you have to wait overnight, TAROM must provide you with free accommodation and free transfer from and to the airport.

1.3 Right to Care

All passengers travelling with TAROM have a right to care.

If your TAROM flight has been delayed, cancelled or overbooked, and you are stuck at the airport waiting for your replacement flight, you have a right to receive care from TAROM. As long as the waiting time is 3 hours or more.

It applies to flight disruptions caused by extraordinary circumstances.

What does it mean for you as a passenger?

TAROM must offer you free meals and drinks in a reasonable relation to the waiting time, two free phone calls, e-mails or faxes. If your new flight is on the next day, the airline has to offer you a free hotel stay and transfer. Agreeing to these free services doesn’t affect your chances of getting compensation.

2. How to Claim TAROM Flight Compensation? How to Claim Flight Overbooking Compensation?

You can claim compensation yourself.

2.1 How Long Does It Take?

It depends on a number of factors.

Like the time of the year and country you are flying from. And how cooperative the airline is. If the airline cooperates, you might receive compensation after 2 to 3 months. If not, after a few months. If the airline wrongly refuses your claim, you will need to take additional steps to get compensation, such as taking the case to a national enforcement body or even court. All of it takes time.

3. How Much Can You Claim?

In the EU compensation amounts are fixed.

In most situations they range from €250 to €600.

Here is how you can calculate TAROM compensation yourself:

When your destination is within the EU/UK:

€250

If the distance of your flight is
up to 1,500 km

€400

If the distance of your flight is between 1,500 – 3,500 km

When your destination is outside the EU/UK:

€250

If the distance of your flight is
up to 1,500 km

€400

If the distance of your flight is between 1,500 – 3,500 km

€600

If the distance of your flight is more than 3,500 km

If you are claiming compensation on your own, these are the amounts you should ask for. If you are entitled to €600, ask for €600. Otherwise you might end up with a smaller sum.

The compensation amounts are regulated by the EU, not the airline.

There’s one exception. When the flight distance is 3500+ kilometres and you reach your destination 3 to 4 hours later than planned, you are entitled only to 50% of the compensation amount (that means €300, not €600).

3.1 TAROM Voucher Code, Discounts or Cash?

According to the law, compensations have to be paid in cash or by bank transfer.

However, airlines do not always obey the law. Don’t be surprised if the airline offers you vouchers as a compensation or refund. If TAROM offers airline vouchers instead of money, do not accept. Ask for bank transfer instead. Because, according to the EU regulations, you are entitled to it.

TAROM Denied Boarding Compensation: FAQ

My flight was cheap. Can I get compensation if the flight is so cheap?

Yes.

As long as your flight is eligible for compensation.

If it is, it doesn’t matter how much did you pay for your flight.

I don’t have travel insurance. Do I need travel insurance in order to claim compensation?

No, you don’t. 

You can claim compensation even if you don’t have insurance. According to the Regulation EC 261/2004, if it’s a delay of at least 3 hours, and it’s due to the fault of the airline, you might be entitled to compensation. It doesn’t matter if you have insurance or not.

Can my kid get compensation from TAROM?

Yes.

Children and babies can get compensation, too.

If you are entitled to flight compensation from TAROM, your child/baby will be, too. Even if your child is an infant who has a special infant ticket.

Your child will get the same amount as you. 

Can I claim compensation for a friend or family member?

Yes, you can claim compensation for another person.

This person will need to provide you with their passport copy and boarding pass. Also they will need to sign any documents the airline or flight compensation company will ask to sign.

How far back can I claim compensation?

It depends on the laws of the country.

In most European countries you can claim compensation even for old flights.

If your flight was 2-3 years ago, you still might be able to claim compensation for it.

What to do if TAROM is refusing to pay compensation?

TAROM is refusing your claim.

Even though your flight is eligible for compensation. 

How can you proceed? There are two options. The best way is to hand over your case to a flight compensation company and let them pursue compensation on your behalf.

Alternatively, you could contact the respective national enforcement body and ask them to help solve your case. There are national enforcement bodies in all the EU Member states.

Problems With Visa or Passport

I was denied boarding due to issues with my visa / passport. Can I get compensation in such cases?

No.

It’s a 100% no. You can only get compensation if you have been involuntarily denied boarding because of overbooking. 

If there’s another reason, you won’t get it.

EU – Non-EU Flights, Tourists

I’m flying to the EU from a country outside the EU. Can I get compensation?

If you’re flying with TAROM then yes, you can.

All TAROM flights and passengers are protected under the EU Flight Compensation Regulation 261/2004. TAROM is an EU airline, and you are protected as a passenger even on their flights that depart from a country outside the EU.

I’m flying from the EU to a country outside the EU. Can I get compensation?

If it’s a TAROM flight, then yes, you can.

I am not a EU citizen. Can I get compensation?

Yes. 

Your nationality doesn’t matter. 

If your flight is eligible for compensation, you can get compensation. Even if you are not from Europe (EU/EEA/UK).

Other Situations

TAROM provided gave me a new flight to my destination and booked me into a hotel (for free). Can I still get compensated for my flight?

Yes. 

If your flight is eligible for compensation, you can get compensation even if you have accepted a free hotel stay and new flight.

TAROM took me to my destination. Can I still get compensation?

Yes.

As long as you arrive 3+ hours later, and the delay is due to the fault of the airline, you might be entitled to compensation. Even if you have accepted a new flight. It doesn’t affect your chances of getting compensation.
